2022: In Review

The year 2022 was an eventful year for immigration legislation. Policies from the new
administration were enacted and lasting legislation from the last administration has been
removed. The American peoples' support for immigration remains high, and expectations for
immigration reform were high for this year, as well. The end of the 2022 fiscal year also saw a
rebound from the pandemic years' drop in issued nonimmigrant visas.


One of the most important changes in 2022 benefits immigrant investors coming through
the newly revitalized EB-5 regional center program. On March 15th, 2022 President Biden
signed the Reform and Integrity Act of 2022. This act allows an applicant to file an application to
adjust status alongside their EB-5 immigrant petition (in situations where a visa is immediately
available to the investor). Furthermore, the act increased the monetary investment value to
$800,000 for targeted employment areas (rural, high unemployment areas) and $ 1,050,000 for
urban EB-5 petitions. Additionally, it has also increased security measures and requirements to
apply. This investor visa remains highly successful and is definitely worth consideration for
foreign nationals looking to come to the U.S. as an investor.


The USCIS has aimed to tackle processing times and address overflowing backlogs, and
there is still progress likely to come this year. Policies enacted in March of 2022 have slowly
been helping, and as the slump of the pandemic years comes to an end, the USCIS also saw a
budget increase for 2022. However, the institution is still underfunded, making it all the more
