EB-5 and E-2 Source of Money

With the EB-5 immigrant investor program and the E-2 nonimmigrant classification from the USCIS, new avenues for citizenship have opened, and tens of thousands of foreign nationals come to the US with these visas each year. The EB-5 visa is an immigrant visa option for those who invest a substantial amount of money into a US business. Conversely, the E-2 visa (although not providing a green card) is for those who wish to start and operate their own business (large or small) in the US.

Both of these visas will require the investor to prove that the money came lawfully, from a legitimate source. In order to do so, documentation will need to be provided regarding where the money came from, how it was made, and the people involved in making the profits. 

Usually, investors for this visa will provide personal tax returns—as well as business tax returns, bank statements, documentation of sold property, and business registration documents to prove that the money was ethically sourced through legal channels.

While no country is restricted from the EB-5 or E-2 programs, many have difficulties obtaining an EB-5 or E-2 visa within groups or governments sanctioned by OFAC (The Office of Foreign Assets Control). OFAC may sanction a government or group of individuals for any number of things, including foreign aggression, sale of narcotics, and terrorist activities.
